1. Acceptance of Terms

By accessing, registering for, or using Cajita ("the Service", "we", "us", or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you must not access or use the Service.

2. Nature of the Service & Software License

Cajita provides a modular web-based digital storefront and link-in-bio software platform. We grant you a limited, revocable, non-exclusive, non-transferable license to access the platform to create, customize, and publish your personal or business landing page in accordance with your active subscription plan.

Cajita is strictly a software technology provider. We do not act as an agent, broker, employee, employer, or partner for any user or creator.

3. User Accounts & Security

You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to immediately notify Cajita of any unauthorized use or security breach.

4. Subscriptions, Billing & Cancellation

Certain features of Cajita require an active paid subscription (e.g. Creator, Pro, Studio tiers). Paid subscriptions are billed in advance on a recurring monthly or annual basis via Stripe.

• Self-Serve Cancellation: You may cancel your subscription at any time directly through the Billing portal in your account settings.
• Access Post-Cancellation: Upon cancellation, your paid features will remain active until the conclusion of the current prepaid billing period.
• Refunds: Subscription fees are non-refundable except where required by mandatory consumer protection law.

5. Intellectual Property Rights

You retain all ownership rights in the text, images, trademarks, and content you upload to your Cajita page. By uploading content, you grant Cajita a worldwide, non-exclusive royalty-free license to host, display, and format your content solely to operate the Service.

All software code, UI designs, animations, and proprietary assets comprising Cajita remain the exclusive property of Cajita.

6. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CAJITA, ITS FOUNDERS, OR OPERATORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL ARISING FROM YOUR USE OF THE SERVICE.

8. Governing Law & Contact

These Terms are governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of law provisions.
